WisdomTree Emerging Markets 3x Daily Leveraged – IE00BYTYHN28

August 22, 2023

The problem with these types of products is establishing what their legal form is and how this relates to the ISA regulations.

This ETP is issued as ‘standard debt’ (see Factsheet below and the Official List of the London Stock Exchange) which is classed/treated as a ‘security’ for ISA qualification purposes. This is the same category as exchange traded commodities (ETCs) that you have referenced. To qualify for ISA inclusion, either the security or the shares in the issuing company need to be listed on a recognised stock exchange or admitted to trading on a recognised stock exchange in the European Economic Area (EEA) or the UK (see ISA Guidance https://www.gov.uk/guidance/stocks-and-shares-investments-for-isa-managers#compsecur ).

In this case, the security is listed on the London Stock Exchange (which is a on a recognised stock exchange) so on that basis, the security should qualify for stocks & shares ISA inclusion.
